Terms of Service

1. Agreement and related policies

By accessing or using rizza.ai, its applications, websites, features, and services (the “Service”), you agree to these Terms, our Privacy Policy, Acceptable Use Policy, Cookie Notice, and Safety & Reporting policy. If you do not agree, do not use the Service. “Rizza,” “we,” and “us” mean Sexted.

2. Adults only

You must be at least 18 years old and at least the age of legal majority where you live. You may not use the Service if adult content is illegal where you are located or if you are barred from using it under applicable law. We may require age or identity verification and may suspend access when we cannot verify eligibility.

3. AI and fictional-character disclosure

All companions are fictional AI characters, and generated messages, images, and videos are synthetic outputs. No companion is a human, sentient, conscious, or capable of real affection, consent, promises, relationships, or offline meetings. Outputs may be inaccurate, inconsistent, offensive, or unexpected. The Service is for entertainment, not medical, mental-health, legal, financial, or emergency advice.

4. Your account

Provide accurate information, keep your credentials confidential, and use only your own account. You are responsible for activity under your account. Tell us promptly if you suspect unauthorized access. We may reject names or profile information that impersonate others or violate these Terms.

5. Your content and permissions

You retain ownership of prompts, messages, photos, and other material you submit (“Input”), subject to rights held by others. You represent that you have all rights and consents needed to provide Input and that every real person visible in an upload is an adult who consented to that use. Never upload a minor or a person who did not consent.

You grant us a worldwide, non-exclusive, royalty-free license to host, copy, transmit, transform, and process Input and generated output only as needed to operate, secure, moderate, improve, and support the Service, comply with law, and use our contracted service providers. Our processing practices are described in the Privacy Policy.

6. Generated output

As between you and Rizza, and to the extent permitted by law, you may use output generated for you for personal, lawful purposes. AI systems can produce similar output for different users. To keep delivery fast and affordable, the Service may deliver the same or similar synthetic output to more than one user when it fits the requested character and context. We do not reuse a photo you upload as another user's output. Output may therefore not be unique or eligible for intellectual-property protection. You are responsible for reviewing output before using or sharing it and for complying with law and third-party rights.

7. Acceptable use and moderation

You must follow the Acceptable Use Policy. We use automated controls to inspect prompts, uploads, and outputs for prohibited material. Flagged material may be reviewed by authorized personnel or safety vendors. We may block requests, remove content, limit features, preserve evidence, suspend or terminate accounts, and report activity when required by law.

8. Purchases, tokens, and subscriptions

Prices, included features, billing cadence, and any renewal terms will be shown before purchase. Virtual tokens are a limited license to access eligible features; they have no cash value, are not transferable, and are not property. Except where required by law or stated at checkout, used tokens and completed digital services are non-refundable. Taxes and payment processor terms may apply. We may correct pricing errors before fulfilling an order.

9. Service license and restrictions

We grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the Service. You may not resell it, scrape it, extract models or datasets, reverse engineer it where prohibited, bypass security or moderation, automate bulk access, interfere with its operation, or falsely present AI output as authentic human-made or real-person media.

10. Our intellectual property

The Service, software, design, brand, and curated characters are owned by us or our licensors. These Terms do not grant rights to our trademarks, systems, or content except for the limited right to use the Service. Feedback may be used without restriction or compensation.

11. Third-party services

The Service relies on third-party infrastructure, authentication, AI, media, analytics, and payment providers. Their services may change or become unavailable, and their own terms may apply where disclosed. We are not responsible for third-party sites you choose to visit.

12. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access, remove content, or refuse service if we reasonably believe you have violated these Terms, created safety or legal risk, failed to pay, or used the Service in a way that could harm users, providers, or the Service. You may appeal a safety enforcement decision through our Safety page.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted or error-free operation. Nothing here limits rights that cannot lawfully be waived.

14. Limitation of liability

To the maximum extent permitted by law, Rizza and its affiliates, personnel, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or loss of goodwill arising from the Service. Our aggregate liability for claims relating to the Service will not exceed the greater of the amount you paid us in the six months before the event giving rise to the claim or US $100. These limits do not apply where prohibited by law.

15. Changes and contact

We may update the Service and these Terms. We will post a new effective date and provide additional notice when legally required. Continued use after an update takes effect means you accept the revised Terms. Questions or legal notices may be sent to legal@sexted.ai.
